DUI Myths: Why Your Cousin's Case Doesn't Mean Yours Will Get Dropped
The biggest myth about DUIs is, oh my cousin got his dropped, I'll be ...
The biggest myth about DUIs is, oh my cousin got his dropped, I'll be fine. Here's the reality. Florida prosecutors are restricted by law on how easily they can just ...drop a DUI. What happens in the good cases isn't a dismissal handed to you. It's a defense attorney finding those cracks. Was the traffic stop legal? Was the breath machine properly maintained? Were the field sobriety exercises given correctly? Usually not. That's where cases get won or reduced, sometimes down to reckless driving.
But none of that happens by just hoping. It happens because someone went through your videos, your stop, and the breath records looking for problems. If you're facing a DUI in Orlando, don't wait for it to magically disappear. Let me look at what actually happened in your case.

Refusing a Breath Test in Florida Is Now a Crime: Trenton's Law Changed Everything
The breathalyzer used to be the one piece of evidence you could refuse ...
The breathalyzer used to be the one piece of evidence you could refuse in a DUI case. The dash cam, field sobriety test, officer's report all happened with or without ...your cooperation. But as of October 2025, refusing to blow is now a crime all by itself. In Florida today, you blow or you've just committed the crime of refusing to blow. When you got your driver's license, you agreed to something called implied consent. You agreed to a breath test if you're lawfully arrested for DUI. For decades, breaking that deal was just a civil problem. You refused, you lost your license, but no criminal charge. That era is over. A law called Trenton's Law changed everything.
Trenton's Law is named for 18-year-old Trenton Stewart from Jacksonville who was killed by a wrong-way driver going over 100 miles per hour. The legislature decided too many impaired drivers were dodging accountability by refusing the test. Now refuse a breath or urine test, even your very first time, and you've committed a second-degree misdemeanor. Up to 60 days in jail and a 500 dollar fine. It's a separate charge. One DUI stop, two criminal cases. Your license still gets suspended one year for a first refusal, 18 months for a second.
The refusal still walks into your DUI trial as consciousness of guilt. The prosecutor gets to argue it. But here's what changed. You used to buy that softer case for free. Today, you buy it by handing the state a guaranteed second criminal charge. The gamble didn't disappear, but it got a lot more expensive.
Should you blow? Yes, because it's a crime to refuse. But hear this, whether you blew or refused, your case is not over. That DUI stop can be challenged. The refusal warning has to be done exactly right. The refusal charge itself has defenses: medical conditions, language barriers, confusion, a stop that never should have happened. There's plenty of defenses, so don't lose hope.

Sealed vs Expunged: The Truth About What Getting Your Record Cleared Actually Does
You cleared the hurdles. You got the judge to seal your criminal ...
You cleared the hurdles. You got the judge to seal your criminal record in Florida. You walked out of the courtroom thinking it's gone, erased, invisible to the entire world. ...Then one day you apply for something and there it is. How? You sealed it. The truth is sealing and expunging are not the same thing and the difference matters. When a record is sealed, it still exists. It's just hidden from public view. The clerk and state agencies like sheriffs and police departments are still holding it. But when a record is expunged, it's stronger. The agencies are ordered to physically destroy their copies. But even with an expunge, FDLE keeps one copy. It exists. And a court can order your expunged case opened.
Here's the catch. Getting your case sealed or expunged gives you the legal right to deny it ever happened. But the law also lists specific situations where you must disclose it. Law enforcement, FBI, CIA, you must tell them. Applying to the Florida Bar to become a lawyer, you must disclose. Seeking a job or license to work with children, the elderly, disabled people, public schools, you must disclose. If you're ever charged with another crime, that cleared record can come back. The good news is sealing and expunging keeps it hidden from routine background checks and your nosy neighbor. But it's not hidden from institutions that matter most around certain careers. If your case was dropped, dismissed, or you were acquitted, you're looking at expunging your record. That's the strongest remedy. If you got a withhold of adjudication, your path is sealing the record. You only get to do this once in a lifetime so you want to get it right your first time.

Florida's Recording Law: When Secret Recording Becomes Legal Evidence
You've probably heard Florida is an all-party consent state. Secretly ...
You've probably heard Florida is an all-party consent state. Secretly recording somebody can be a felony under 934.03. But there's a line. Once somebody crosses it, that secret recording isn't ...illegal at all. It's actually admissible right in front of the jury. In State v. Inserano, a man in his office had a tape recorder running. When Inserano walked in, the tape captured the entire conversation and then gunshots. Inserano committed a crime in that office, and the victim's own recorder captured it all. Inserano's defense tried to suppress the recording under the wiretap statute. His argument: I never consented to being recorded.
Florida is an all-party consent law. But the motion to suppress didn't work. Here's why. The statute only protects an oral communication with a reasonable expectation of privacy. When you walk into someone's office intending to commit a crime, you have no legitimate expectation of privacy in what you say. So his words weren't a protected communication.
But compare that to another case, McDade, where a man confessed to crimes in his own bedroom. A bedroom is about as private a place as exists. He won the privacy argument and that tape got suppressed. Same statute, completely opposite outcome. The real takeaway is whether your recording is a felony or golden evidence comes down to one fact-specific question a judge decides after the fact. Did the other person have a reasonable expectation of privacy? If you guess wrong, the tape you were counting on becomes the felony you get charged with. When it really matters, talk to a lawyer before you hit record.

Missed Your Court Date? Here's What Happens and How to Fix It
You missed a court date and now you're terrified. Here's what actually ...
You missed a court date and now you're terrified. Here's what actually just happened and what to do about it. When you fail to appear, the judge typically issues a ...bench warrant. It's an order for your arrest and until it's resolved, you can be picked up anytime. A routine traffic stop turns into a trip to jail. But here's what people don't realize. Failing to appear can also be charged as a separate crime in Florida on top of whatever else you were facing. A missed court date isn't just an inconvenience. It compounds your problem. Brevard County is notorious for charging this. Orange County usually doesn't. It varies per county.
But the good news is that a bench warrant is often fixable. A defense lawyer can file a motion to recall or quash the warrant and get you back on the court's calendar. Ideally before you've spent a night in jail. That's what we're trying to do. But the worst move is to do nothing and hope it goes away. It doesn't go away. It just waits for you. Trenton's Law: When Laws Written in Grief Go Too Far
Eighteen-year-old Trenton Stewart, a freshman college football player, ...
Eighteen-year-old Trenton Stewart, a freshman college football player, was driving home one night when a man named Ariel Monteguto came speeding toward him in the wrong lane at over 100 ...miles per hour. Monteguto was high on cocaine and marijuana. He had already served 10 years in prison for killing someone in a DUI crash once before. Trenton never had a chance. His mother, Mandy, buried her son and then spent two years walking the halls of Tallahassee telling his story to anyone who would listen. She turned the worst night of her life into a law, and the governor of Florida signed it. They called it Trenton's Law.
Trenton's Law does two things. First, it raises the penalty for repeat DUI offenders who cause loss of life from 15 years to 30 years. A person who kills, gets out, and kills again should answer for both. I understand that one. But the second thing I have a problem with. Trenton's Law also makes it a crime to refuse a breath or urine test. First timer, no accident, nobody hurt, you say no, you've committed a crime. Up to 60 days in jail just for the refusal. But here's the issue. Florida already had this covered. When somebody actually is suspected of DUI and causes a loss of life or serious injury, Florida statute 316.1933 lets officers demand your blood by reasonable force. In a fatal crash, they get a warrant in about 20 minutes. No judge in Florida turns that warrant down. So the state already had the power to get what they needed.
Two things can be true at the same time. It's true this law was written out of a mother's love for a boy who should be alive right now. And it's also true that a law written in grief goes further than the grief requires. We already had a tool for the worst night imaginable. We didn't need to turn every refusal into a crime for every driver in Florida to honor Trenton Stewart.
