The Squealing Tires Rule for Florida Stops

Illegal Traffic Stop in Florida: The Squealing Tires Rule

Getting pulled over by the police is highly stressful. However, officers cannot simply detain you on a whim.

Specifically, law enforcement must possess a valid legal reason to initiate a traffic stop. If an officer pulls you over unlawfully, the entire case can quickly fall apart.

Facing Criminal Charges After a Traffic Stop?

Do not assume the state has an open-and-shut case against you. Frequently, police officers violate constitutional protections during roadside investigations. Therefore, a skilled lawyer can fight to suppress the state’s evidence. Contact our office today to protect your freedom.

When Is a Traffic Stop Unlawful in Florida?

Let us look at a real-world example from my defense practice. I once represented a client with a high-performance sports car. Naturally, his vehicle featured a massive engine.

One afternoon, he accelerated away from a stop. Consequently, his tires accidentally emitted a brief squeal.

The visual above demonstrates a standard roadside vehicle stop. When an officer pulls you over based on a minor vehicle noise, the legal validity of the detention becomes highly questionable.

A nearby police officer immediately activated his emergency lights. The officer initiated a full vehicle stop based solely on that single, brief tire bark.

The Legal Threshold for Traffic Noise

Was this traffic stop lawful? Absolutely not. To clarify, a minor tire bark is not a traffic crime.

Certainly, the situation shifts if you are driving recklessly. For instance, spinning your tires to create massive clouds of white smoke justifies a stop. Doing burnouts like you just won the Daytona 500 will get you arrested.

However, a brief tire squeal without reckless maneuvering does not violate Florida traffic statutes. Therefore, that officer lacked the required reasonable suspicion to detain my client.

The Constitutional Rule: If the initial traffic stop is completely illegal, the police cannot use any evidence they find afterward.

The interactive evaluator below demonstrates how specific driving behaviors dictate the legal validity of a police traffic stop under Florida guidelines.

Suppressing the Fruit of the Poisonous Tree

During this unlawful vehicle investigation, the officer searched the car. Consequently, they discovered a significant quantity of illegal drugs.

The prosecution believed they possessed an ironclad case. They expected an easy conviction in circuit court.

Nevertheless, we filed a formal motion to suppress the evidence. Because the initial stop lacked legal justification, the judge threw out all the recovered contraband. Consequently, the state had to dismiss every single drug charge against my client.

Final Thoughts

Challenging the initial traffic stop is often the most powerful tool in your defense strategy.

Look Closely at the Officer’s Excuse

Never assume the police acted legally when they pulled you over. Often, officers use minor, non-criminal behaviors as an excuse to conduct an investigation. Examining their exact reasoning can reveal critical flaws that can destroy the state’s case completely.
