Do I Need to Use the Same Attorney on My Expunge?
Do I need to use the same attorney for my expunge as I used on the original case? I love this question, and, my answer is pretty simple, and pretty self-serving I suppose. No, you do not need to use the same attorney for your seal and expunge as you used for your original case. Sometimes it helps to have a fresh set of eyes on your seal and expunge case, so we would be happy to erase your criminal history even though we didn’t handle the charges up front. That is no problem, and I encourage you to hire someone different. Go for it.
That being said, let’s get to the “but”, and there’s always a but. So, if your case was dropped but very serious, like a child molestation case, or really any type of sex case, or a home invasion, for example. In those cases, as much as I’d love to help you expunge that dropped charge (and I will), it may save you some money to go back to your original attorney who knows the facts of the case.
So on serious charges ONLY, I suggest you check in with your original attorney before you search for a new attorney–it might save you some money! Thanks for watching, and take care.
