HOW CAN I EARLY TERMINATE MY PROBATION IN CENTRAL FLORIDA? FAQs
Q: What are the basics of early termination of probation?
A: To seek early termination of probation, you must have completed all the conditions of your probation. I know this sounds obvious, but you’d be surprised how many people still have more fines to pay, or a few more counseling classes to complete–and they get rejected because they’ve asked too soon. When we say have it ALL DONE, this includes paying all fines, covering the cost of supervision, completing community service, and finishing any required counseling. For those on sex offender probation, counseling can last many years, and early termination is not possible until the counseling is fully completed (technically, I’ve had a client early terminated before completing the counseling, but it was special circumstances!).
Q: What if I have previously violated my probation?
A: If you have violated your probation and been reinstated, your chances of early termination are not good. Just saying. Most judges are reluctant to grant early termination in such cases. While it never hurts to ask, it is generally not advisable to spend much money pursuing this option if you have prior violations.
Q: Are there any conditions in the plea form that can affect my chances?
A: Yes, if your plea form includes the phrase “no early term,” you are not eligible for early termination of probation. If this restriction is not in your plea form, you can proceed with your request for early termination.
Q: Do I have to wait until the halfway point of my probation to seek early termination?
A: No, you do not necessarily have to wait until the halfway point of your probation. I recommend waiting to the halfway point, but it is not mandatory. Some judges are willing to consider early termination before the halfway mark. However, it is important to know the judges’ tendencies to handle your case. Some judges are known never to grant early termination, regardless of the circumstances.
Q: How can I improve my chances of early termination?
A: Beyond completing all the requirements of your probation, it helps to present a compelling personal story to the judge. Explain how early termination will positively impact your life, such as by enabling you to take a job promotion or pursue a career path that is currently off-limits due to your probation status. Judges are more likely to respond favorably if they see that early termination will help you progress in life. We want the judge to feel good about terminating your probation early.

A: The mandatory early termination provisions in Florida law, which took effect on October 1, 2019, are a separate matter. These provisions may make you eligible for early termination under certain conditions. If you believe you qualify, you should watch my separate video for more details.
